Minimum Advertised Price (“MAP”) Policy for Facialworks Wholesale Accounts

At Facialworks, we greatly value our wholesale accounts and the partnership we share with you. To maintain the integrity and fair competition within the market, we have established this Minimum Advertised Price (“MAP”) policy, which outlines the guidelines and requirements for our wholesale partners in advertising and selling Facialworks products. By purchasing our products for wholesale, you agree to adhere to the following MAP policy:
- Online Selling Restriction: Wholesale accounts are strictly prohibited from selling Facialworks products through any online channels, including but not limited to websites, social media platforms, online marketplaces, and auction sites. The resale of Facialworks products must be conducted through brick-and-mortar stores only.
- Price Maintenance: Wholesale accounts must maintain price levels not below the minimum advertised price, which is the current price as shown at com. Any deviation below this price is strictly prohibited.
- Geographical Price Alignment: a. Wholesale accounts must align their pricing with the geographically closest Facialworks facial spa. This means that the prices offered by wholesale accounts should be consistent with the prices offered at the nearest Facialworks facial spa in the same geographical region. b. In cases where there is no Facialworks outlet within a 50-mile radius, wholesale accounts are required to base their pricing as described in item 2 above.
- Breach of Agreement Consequences: If Facialworks identifies any wholesale account in breach of this MAP policy, we reserve the right to take the following actions: a. Issue a written warning to the account, notifying them of the policy violation and providing a grace period for correction. b. If the violation continues after the grace period, Facialworks may suspend or terminate the wholesale account’s privileges to purchase our products. c. Facialworks also reserves the right to refuse further sales of our products to the account at our discretion.
- Policy Amendments: Facialworks reserves the right to modify or update this MAP policy at any time without prior notice. The updated policy will be communicated to all wholesale accounts via email or other appropriate means.
By continuing to purchase and resell Facialworks products, you acknowledge that you have read, understood, and agreed to comply with this MAP policy. This policy is designed to protect the brand image of Facialworks and maintain fair competition among our valued wholesale partners.
